Further to The Fair Work Commission’s (FWC) decision of 5 July 2017 in the 4 yearly modern award review, the FWC issued a statement confirming the following changes will take effect from 1 January 2018:

Changes-to-Casual-and-Part-Time-Employment-Provisions-in-Modern-Awards-to-Take-Effect-from-1-January-2018

1.   Extending the application of overtime penalty rates to casual employees in the:

  • Fast Food Industry Award 2010
  • General Retail Industry Award 2010
  • Hair and Beauty Award 2010
  • Hospitality Industry Award 2010
  • Restaurant Industry Award 2010
  • Registered and Licensed Clubs Award;

2.    Amending part time rostering provisions in the following Awards:

  • Hospitality Industry Award 2010
  • Registered and Licensed Clubs Award 2010
  • Restaurant Industry Award 2010
  • Pastoral Award 2010
  • Social, Community, Home Care and Disability Services Industry Award 2010;

3.    Reduction of the minimum engagement period for casual dairy operators (who are currently full time school students) in the Pastoral Award 2010;

4.    Changes to the minimum engagements for casual employees in the Wine Industry Award 2010; and

5.    Variations to the minimum engagement provisions of the Passenger Vehicle Transportation Award 2010.

We are recommending to all clients that are employers to review their current rostering practices for part time and casual employees to ensure compliance with the changes.
